Privacy Policy
TouchPoint Mortgage ("TouchPoint," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit touchpointmortgage.io, request a rate quote, chat with our AI assistant Ava, or otherwise interact with our services. It also explains how we use, retain, and share that information, and the choices you have.
This policy applies to touchpointmortgage.io and any subdomains. It does not apply to third-party sites we link to, including social media platforms and partner sites.
1. Information we collect
Information you give us
- Loan inquiry form: ZIP code, property value, loan amount, credit range, name, email, phone, and any free-text notes you include.
- Callback form: name, phone, email, and the time you requested a callback.
- AI chat with Ava: the questions you ask and the conversation we hold, until you close the chat or 30 days pass, whichever comes first.
- Phone calls with our AI voice agent: if you call our published phone number, the call may be recorded or transcribed for quality and compliance. This disclosure is also given at the start of every call.
- Loan application: when you formally apply, we collect the full set of information needed to underwrite your loan, including income, employment, assets, debts, Social Security number, and bank information.
Information we collect automatically
- Device and usage: IP address, browser type, device type, operating system, referring URL, pages viewed, and approximate location derived from IP.
- Cookies and similar: we use essential cookies to keep the site working and a small number of analytics cookies to measure traffic. We do not use advertising cookies.
Information from third parties
- Credit bureaus: only after you authorize a hard inquiry. The initial rate quote uses a soft inquiry that is not visible to lenders and does not affect your FICO score. See question 2 below for details.
- Service providers: our AI provider, voice provider, lead routing platform, and hosting provider may process data on our behalf under written agreements.
2. How we use your information
- To provide rate quotes, pre-qualification, and loan applications.
- To operate and improve the site, including debugging, security, and analytics.
- To communicate with you about your inquiry, including by phone, email, SMS (where you have consented), and our AI assistant Ava.
- To route your lead to a licensed loan officer or to your state of residence as required.
- To comply with legal and regulatory obligations, including anti-money-laundering, fair lending, and recordkeeping requirements.
We do not use your loan inquiry data to train third-party AI models. Our AI provider processes conversations under a zero-retention configuration, meaning your conversation text is not retained or used for model training.
3. How we share your information
We do not sell your personal information. We do not share it with third-party advertisers. We share information only in the following cases:
- Service providers: OpenAI (AI chat, zero-retention), Retell AI (voice calls), n8n (lead routing), Bluehost (hosting), and Google (analytics, Workspace tools). Each operates under a written agreement limiting use to providing services to us.
- Loan officers and partners: when you submit a quote form or request a call, we route your information to a licensed loan officer licensed in your state of residence. If your state is not currently served, we hold your inquiry for the next state expansion and contact you.
- Credit bureaus: only with your authorization, when you formally apply for a loan.
- Regulators and law enforcement: when legally required, including in response to subpoenas, court orders, and regulatory inquiries.
- Business transfers: if TouchPoint is acquired or merges, your information may transfer to the acquiring entity under the same protections described here.
4. Cookies and tracking
We use cookies for the following purposes:
- Essential: session integrity, form submission, security.
- Analytics: aggregated, de-identified traffic measurement (Google Analytics).
We do not use advertising or cross-site behavioral tracking cookies. You can disable cookies in your browser settings; the site will still work for browsing, but the rate form and AI chat require JavaScript and cookies to function.
5. Data retention
We retain personal information only as long as needed for the purposes described in this policy, then delete or anonymize it. Specific retention periods:
- Quote forms: 24 months from submission, unless you request earlier deletion.
- AI chat conversations: 30 days from the conversation end, then deleted.
- Phone call recordings: 6 years, in line with federal recordkeeping requirements for mortgage lenders.
- Loan applications: 5 years after the loan closes or the application is withdrawn, per federal recordkeeping rules.
6. Security
We protect your information with commercially reasonable safeguards: TLS encryption in transit, encryption at rest in our databases, role-based access controls, and audit logs on systems that process personal data. No system is perfectly secure; if you have reason to believe your interaction with us is no longer secure, please contact us immediately.
7. Your choices and rights
Everyone
- Access: you can request a copy of the personal information we hold about you.
- Correction: you can ask us to fix information that is wrong.
- Deletion: you can ask us to delete information we have about you, subject to legal recordkeeping obligations that may require us to keep certain data.
- Opt out of marketing: every marketing email includes an unsubscribe link. SMS opt-out: reply STOP.
California residents (CCPA / CPRA)
You have the right to know what categories of personal information we collect, the right to delete, the right to correct, and the right to limit the use of sensitive personal information. We do not sell or share your personal information for cross-context behavioral advertising. To exercise these rights, contact us at the address below. We will respond within 45 days.
Michigan residents
Michigan residents may request information about disclosures of certain personal information to third parties for marketing purposes. TouchPoint does not make such disclosures.
8. Children
Our services are not directed to children under 18, and we do not knowingly collect information from children.
9. International visitors
Our services are intended for residents of the United States. If you visit from outside the US, your information will be transferred to and processed in the United States.
10. Do Not Track
We honor Do Not Track and Global Privacy Control browser signals as opt-outs of analytics cookies where technically feasible.
11. Changes to this policy
We may update this policy from time to time. When we do, we will change the "Last updated" date above. Material changes will be communicated by a banner on the homepage for at least 30 days.
